Welcome to Fyndin. These Terms & Conditions (“Terms”) govern your access to and use of the Fyndin website, platform, services, accounts, publishing features and related products or services (collectively, the “Platform”).

By accessing, browsing, registering for an account, submitting content, publishing an article, or otherwise using Fyndin, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use the Platform.

Fyndin may update these Terms from time to time. Your continued use of the Platform after changes are published means that you accept the revised Terms.

1. About Fyndin

Fyndin is an information and knowledge platform focused on providing useful, educational, technological, professional, government-service, business, entertainment and other informational content, with a particular focus on Rwanda and Africa.

Fyndin may publish content created by its editorial team, independent contributors, registered authors, partners and other users.

Fyndin is an independent information platform unless a specific page clearly states otherwise. References to government institutions, companies, organizations, products or services do not necessarily mean that Fyndin is affiliated with, endorsed by, sponsored by or officially connected to those entities.

2. Acceptance of These Terms

By using Fyndin, you confirm that:

You have read and understood these Terms.
You agree to comply with these Terms and applicable laws.
The information you provide to Fyndin is accurate to the best of your knowledge.
You will not use Fyndin for unlawful, fraudulent, abusive or harmful activities.

If you are using Fyndin on behalf of an organization or another person, you confirm that you have the authority to accept these Terms on their behalf.

3. Eligibility

You may use Fyndin only if you are legally capable of entering into an agreement under the laws applicable to you.

Some features, including author accounts, publishing, rewards or other services, may have additional eligibility requirements. Fyndin may restrict access to particular features where necessary.

4. User Accounts

Certain Fyndin features may require you to create an account.

When creating an account, you agree to:

Provide accurate and current information.
Keep your login credentials confidential.
Use only your own account unless Fyndin expressly permits otherwise.
Notify Fyndin if you believe your account has been compromised.
Not impersonate another person or organization.
Not create accounts for fraudulent, abusive or deceptive purposes.

You are responsible for activities carried out through your account where those activities result from your failure to properly protect your credentials.

Fyndin may suspend, restrict or terminate accounts that violate these Terms or applicable law.

5. User-Generated Content

Fyndin may allow registered users or approved authors to submit articles, images, videos, comments, reviews, opinions, links and other material (“User Content”).

You remain responsible for the User Content you submit or publish.

By submitting User Content, you represent and warrant that:

You own the content or have sufficient rights and permissions to submit it.
The content does not unlawfully copy or infringe another person's intellectual property.
The content is not knowingly false, fraudulent or misleading.
The content does not unlawfully disclose another person's private or confidential information.
The content does not contain malware, malicious code or harmful files.
The content complies with these Terms and applicable laws.

6. Content Standards

Fyndin aims to maintain a useful, trustworthy and respectful information platform. Content submitted to Fyndin should be relevant to the subject being discussed and should not intentionally mislead readers.

Users and authors must not submit or publish content that:

Promotes illegal activities.
Contains fraudulent schemes or deceptive offers.
Encourages violence or serious wrongdoing.
Harasses, threatens or deliberately targets individuals.
Contains defamatory allegations presented as facts without a reasonable basis.
Infringes copyrights, trademarks or other intellectual-property rights.
Contains stolen, hacked or unlawfully obtained information.
Impersonates an individual, organization or government institution.
Contains malicious software or attempts to compromise another person's device or account.
Violates applicable privacy or data-protection laws.

7. Editorial Review and Content Moderation

Fyndin may review, edit, reject, restrict, unpublish or remove User Content at its discretion where it considers such action necessary to maintain the quality, safety, legality or integrity of the Platform.

Editorial review does not guarantee that every statement published on Fyndin is accurate, complete or current.

Fyndin may make reasonable editorial changes to improve readability, formatting, clarity, accuracy or search presentation while attempting to preserve the intended meaning of an author's submission.

8. Accuracy of Information

Fyndin aims to provide accurate and useful information, but information published on the Platform may change over time.

This is particularly important for information relating to government services, application procedures, fees, employment opportunities, education, technology, financial services, laws, deadlines and other time-sensitive subjects.

Readers should verify important information with the relevant official institution, service provider or other authoritative source before making decisions or taking action.

Fyndin does not guarantee that information will always be:

Accurate;
Complete;
Current;
Available without interruption; or
Suitable for your particular circumstances.

9. Government and Official-Service Information

Fyndin may publish guides explaining how to access government services, websites, portals and public institutions.

Unless expressly stated otherwise, Fyndin is an independent information publisher and is not a government website.

Fyndin does not control government websites, application systems, processing times, fees, eligibility decisions, appointment availability or the outcome of applications submitted through third-party or government platforms.

Where appropriate, users should confirm requirements and procedures directly with the relevant official institution before submitting an application or making a payment.

10. Intellectual Property

Unless otherwise stated, the Fyndin website, including its design, branding, logos, original graphics, interface elements, software, original editorial material and other Fyndin-owned materials, is protected by applicable intellectual-property laws.

You may access and use Fyndin content for personal, educational or other lawful purposes permitted by these Terms.

You may not reproduce, republish, sell, redistribute, modify or commercially exploit substantial portions of Fyndin-owned content without appropriate permission.

11. Copyright in Author Content

Authors generally retain ownership of original intellectual property they lawfully create and submit to Fyndin, unless a separate written agreement states otherwise.

By submitting content to Fyndin, you grant Fyndin a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, distribute, format, edit and promote that content as reasonably necessary to operate, market and improve the Platform.

This licence may include displaying the content on Fyndin, distributing it through search engines, social-media channels, newsletters, applications, feeds or other Fyndin-controlled or authorized distribution channels.

The licence continues for as long as reasonably necessary to maintain previously published or archived versions of the content, subject to applicable law and any separate agreement between Fyndin and the author.

12. Copyright Complaints

If you believe content published on Fyndin infringes your copyright or other intellectual-property rights, you may contact Fyndin and provide sufficient information to identify:

The work or material you claim to own.
The allegedly infringing content.
Your contact information.
Evidence supporting your ownership or authorization.
A description of the issue and requested action.

Fyndin may investigate legitimate complaints and may remove or restrict disputed content where appropriate.

13. Author Program and Rewards

Fyndin may offer an author, contributor, rewards or revenue-sharing program under which eligible authors may receive rewards or payments based on criteria established by Fyndin.

Participation in such a program is not guaranteed and may be subject to separate eligibility requirements, verification procedures, payment rules and program-specific terms.

Unless Fyndin expressly guarantees otherwise:

Creating an author account does not guarantee earnings.
Publishing an article does not guarantee payment.
Views, engagement or other statistics may not automatically qualify for rewards.
Fyndin may exclude fraudulent, artificial or manipulated traffic.
Fyndin may change reward calculations, eligibility requirements or program rules prospectively.
Fyndin may withhold or reverse rewards associated with fraud, manipulation, prohibited activity or inaccurate information.

Authors are responsible for providing accurate payment and identification information where required.

Authors may also be responsible for any taxes, declarations or other legal obligations associated with income they receive through the Platform, depending on applicable law.

14. Prohibited Traffic and Manipulation

Authors and users must not artificially manipulate Fyndin traffic, views, engagement or other metrics.

Prohibited activity may include:

Using bots or automated systems to generate views.
Purchasing fraudulent traffic or engagement.
Repeatedly refreshing pages for the purpose of increasing statistics.
Using scripts or technical methods to manipulate Platform measurements.
Organizing deceptive activity designed to increase rewards.
Using compromised accounts, devices or networks to generate artificial activity.

Fyndin may investigate suspected manipulation and take appropriate action, including removing content, suspending accounts or withholding rewards.

15. Advertising and Sponsored Content

Fyndin may display advertisements, sponsored content, affiliate links, promotional materials or other commercial content.

Advertising or sponsorship does not necessarily mean that Fyndin endorses the advertised product, service or company.

Where appropriate, sponsored or promotional content may be identified as such.

16. Third-Party Websites and Services

Fyndin may contain links to third-party websites, applications, services or resources.

These links are provided for convenience and informational purposes. Fyndin does not control third-party websites and is not responsible for their content, availability, security, privacy practices, products, services or terms.

Your use of third-party websites is subject to the terms and policies of those third parties.

17. Affiliate Links

Some links on Fyndin may be affiliate links. This means Fyndin may receive a commission or other benefit if you make a qualifying purchase or take another qualifying action through the link.

Affiliate relationships do not necessarily affect the editorial independence of Fyndin's content.

18. Privacy and Personal Data

Fyndin may collect and process personal information when users create accounts, contact Fyndin, submit content, interact with the Platform or use certain services.

Fyndin will handle personal data in accordance with its Privacy Policy and applicable data-protection laws.

Rwanda's Law No. 058/2021 relating to the Protection of Personal Data and Privacy establishes requirements concerning the processing and protection of personal data.

Users should review Fyndin's Privacy Policy to understand what information may be collected, why it is processed, how it may be used, and the rights available to individuals.

19. Security

Fyndin takes reasonable measures to protect the Platform and user information. However, no internet service can be guaranteed to be completely secure.

You agree not to:

Attempt to gain unauthorized access to Fyndin systems.
Test or circumvent security measures without authorization.
Introduce malware or malicious code.
Interfere with the operation of the Platform.
Attempt to access another user's account.
Use automated systems in a manner that places unreasonable load on Fyndin infrastructure.

20. Comments and Community Interaction

If Fyndin provides comments, discussions or other community features, users must communicate respectfully and lawfully.

Fyndin may remove comments or restrict commenting privileges where necessary to prevent spam, harassment, abuse, unlawful activity or disruption of the Platform.

21. No Professional Advice

Information published on Fyndin is generally provided for informational and educational purposes.

Unless expressly stated otherwise, Fyndin content should not be treated as legal, medical, financial, investment, accounting, immigration, employment or other professional advice.

Where a decision could have significant legal, financial, medical or personal consequences, you should consult an appropriately qualified professional.

22. Availability of the Platform

Fyndin aims to keep the Platform available and functional, but uninterrupted access cannot be guaranteed.

The Platform may occasionally be unavailable because of:

Maintenance;
Technical problems;
Security incidents;
Hosting or infrastructure issues;
Third-party service failures;
Network problems; or
Other circumstances outside Fyndin's reasonable control.

Fyndin may modify, suspend or discontinue parts of the Platform where reasonably necessary.

23. Limitation of Liability

To the maximum extent permitted by applicable law, Fyndin and its owners, operators, employees, contributors, partners and service providers will not be responsible for losses or damages arising from your use of or reliance on information available through the Platform, including information that is inaccurate, outdated, incomplete or unavailable.

This includes, where legally permitted, losses resulting from:

Reliance on an article or guide.
Government-service procedures or changes.
Third-party websites or services.
Job applications or application outcomes.
Educational applications or admissions.
Financial decisions.
Loss of data.
Website interruptions.
Unauthorized access caused by circumstances outside Fyndin's reasonable control.

Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law.

24. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless Fyndin and its owners, operators, employees, contributors and service providers from claims, losses, liabilities, costs and reasonable expenses arising from:

Your violation of these Terms.
Your User Content.
Your violation of another person's rights.
Your unlawful use of the Platform.
Your fraudulent or abusive activities.

25. Account Suspension and Termination

Fyndin may suspend, restrict or terminate an account where it reasonably believes that the account or its activities:

Violate these Terms.
Infringe the rights of others.
Involve fraud or manipulation.
Create a security risk.
Involve unlawful activity.
Damage the integrity or reputation of the Platform.

Fyndin may also remove or restrict access to content that violates these Terms or applicable law.

26. What Happens After Account Termination?

When an account is terminated, you may lose access to account features and unpublished materials associated with that account.

Termination does not automatically remove content that Fyndin is legally required or otherwise reasonably entitled to retain, including records necessary for security, fraud prevention, dispute resolution, legal compliance or legitimate business purposes.

27. Changes to Fyndin

Fyndin may add, modify, remove or replace features, services, content formats or other aspects of the Platform.

Fyndin may also change these Terms when reasonably necessary to reflect changes to the Platform, applicable law, business operations or security requirements.

When material changes are made, Fyndin may provide notice through the Platform or other reasonable means.

28. Changes to Author Rewards

If Fyndin operates an author rewards program, the program rules may change as the Platform develops.

Any new reward calculation or eligibility rule will generally apply prospectively unless applicable law or a separate written agreement requires otherwise.

Fyndin reserves the right to suspend a rewards program or modify it where necessary because of fraud, technical changes, business requirements, legal requirements or other legitimate reasons.

29. Governing Law

These Terms shall be interpreted in accordance with the applicable laws of the Republic of Rwanda, except where mandatory laws applicable to a user require otherwise.

Nothing in these Terms prevents a consumer or other user from exercising mandatory rights that cannot legally be waived or restricted by contract.

30. Dispute Resolution

If you have a dispute with Fyndin, we encourage you to contact us first so that we can attempt to resolve the matter informally.

If the dispute cannot be resolved informally, it may be handled through the competent dispute-resolution mechanism or courts having jurisdiction under applicable law.

31. Severability

If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable, where legally permitted.

The remaining provisions will continue to apply.

32. No Waiver

If Fyndin does not immediately enforce a provision of these Terms, that does not mean Fyndin has waived its right to enforce the provision later.

33. Entire Agreement

These Terms, together with any applicable policies or additional terms referenced by them, constitute the agreement governing your use of the Fyndin Platform, except where a separate written agreement expressly applies.

35. Important Notice
